Subject:    Application for permission to set up ICD at Village Garhi Harasaru Distt. Gurgaon by M/s Continental Warehousing Corporation Ltd. - Regarding.

        I am directed to refer your letter No. C. No.IV (16)240/ Tech/ DIII/ 98/ 2946 dated 6/5/98 on the above subject. The following issues raised by you in above mentioned letter have been examined in Board's office:-

    (i)    Security arrangement at such ICD to avoid pilferage & safeguarding of government revenue in case of such pilferage.

    (ii)    Verification of antecedents of private sector applicants from various Ministries concerned; such as Department of Banking, Ministry of surface Transport, Income Tax Department, DGAE, DGRI & Enforcement Directorate.

        It is for the custodian of ICD to make necessary arrangement to prevent pilferage. They have also to execute bond for payment of duty on pilfered goods & to pay duties on pilfered goods u/s 45(3) of the Customs Act 1962. They are required to provide flood light, high mast towers, high boundary wall and other security arrangements for ICD/ CFS to the satisfaction of the Commissioner of Customs.

        Regarding verification of antecedents of private sector applicants, if  required necessary enquiries may be made only with Directorate General of Revenue Intelligence, Directorate General of Anti Evasion and Enforcement Directorate but such enquiries must be completed within 2 months of receipt of proposal in Commissionerate and the proposals must not be delayed on this account.

        The difficulty, if any, in implementation may be brought to the notice of Board.
