Anti-Dumping Duty on parts/components of Compact Fluorescent Lamps (CFL) from
China and Hong Kong as per Customs Notification No.138/2002-Cus dated 10.12.2002
reg.
It has been represented to the Board by the Morbi Chamber of
Commerce & Industry, Gujarat, that the clarification given by the Designated
Authority, Department of Commerce is not being followed while deciding about the
applicability of anti dumping duty on parts/Components of CFL.
2. In this regard, it is stated that final/definitive anti dumping duty vide
notification No.138/2002- Cus dated 10.12.2002 was imposed in respect of CFL on
the basis of recommendations of the Directorate General of Anti dumping. The
anti dumping duty imposed in the aforesaid notification applies to import of
Compact Fluorescent Lamps (CFL) from Peoples Republic of China and Hong Kong at
specified rates.
3. The Directorate General of Anti Dumping and Allied Duties (DGAD) have
clarified that antidumping duties were not recommended on parts/components of
CFL. It has been stated by them that the anti-dumping in the above notification
was recommended only in respect of two types of CFLs (i) Complete, ready to use
compact fluorescent lamps wherein choke is integrated within the lamp (ii)
Complete, ready to use compact fluorescent lamps wherein choke is external.
4. In view of the above, it is hereby clarified that the Anti-Dumping Duty
imposed vide notification No.138/2002-Customs dated 10.12.2002 does not apply to
the parts/components of CFL. In view of the above, you are requested to finalise
all the pending assessments, if any, accordingly.
