Notification No. 40/2003 - Central Excise 

            In exercise of the powers conferred by sub-section (1) of section 5A of the Central Excise Act, 1944 (1 of 1944), read with sub-section (3) of section 3 of the Additional Duties of Excise (Goods of Special Importance) Act, 1957 (58 of 1957) and sub-section (3) of section 3 of the Additional Duties of Excise (Textiles and Textile Articles) Act, 1978 (40 of 1978), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments in the notification of the Government of India in the erstwhile Ministry of Finance and Company Affairs (Department of Revenue) No.56/2002-Central Excise, dated the 14^th November, 2002, namely:- 

In the said notification, in  Annexure II,  under heading “2. JAMMU PROVINCE”,- 

(A) in sub-heading “(I) DISTRICT JAMMU”, - 

(a) under heading “ (B) Existing location run by Directorate of Industries & Commerce/ SIDCO / SICOP ”, in the Table- 

(i) against S.No. 2, under column heading Khasra Nos,  after Khasra No. “398-min399”, the Khasra Nos. “,882, 883, 892, 515-m, 517, 517/2, 463, 457, 933, 358/2, 88, 68-m, 72-m, 851, 367 to 382, 385 to 391, 397, 398 to 404, 851, 797, 863, 892, 850, 852, 740 to 778, 499” shall be inserted;

(ii) against S.No. 3, under column heading Khasra Nos, after Khasra No. “65/428”, the Khasra Nos. “,180, 211, 509, 25/98m, 48” shall be inserted; 

(b) under heading “ (C) Existing location run by Directorate of Industries and Commerce”, in the Table-  

(i) against S.No. 1, under column heading  Khasra Nos, after Khasra No. “1959”, the Khasra No. “,1263” shall be inserted;

(ii) against S.No. 3,-

(A) in item  (e) relating to village Mendhera Sambha, under column heading Khasra Nos, for  Khasra Nos. “31 to 34”, the Khasra Nos.“31 to 35” shall be substituted,

(B) in item (f) relating to village Karandi Samba, under column heading Khasra Nos., after Khasra No. “36-m”, the Khasra Nos. “,15, 16, 17” shall be inserted; 

(c) under heading “ (D) Commercial Estates on private land”, in the Table-  

(i) against S.No. 1, under column heading Khasra Nos, after Khasra No. “96”, the Khasra Nos. “,267, 416, 550, 427, 548” shall be inserted;

(ii) against S.No. 2, under column heading Khasra Nos, after Khasra No. “267”, the Khasra Nos. “,64, 98, 180m, 183, 435, 664, 743, 744, 843, 667, 668/1” shall be inserted;

(iii) against S.No. 3, under column heading Khasra Nos, for  Khasra Nos  “1006-min and 346-min” the Khasra Nos. “1006-min, 346-min, 1005” shall be substituted;

(iv) against S.No. 4, under column heading Khasra Nos, for Khasra No. “247”, the Khasra Nos.“ 64, 64-min, 125 to 162, 247 to 252, 7 to 12, 718 to 807, 845” shall be substituted;

(v) against S.No. 5, under column heading Khasra Nos, for  Khasra Nos. “937 & 733” the Khasra Nos. “937, 733, 37” shall be substituted;

(vi) against S.No. 6, under column heading Khasra Nos, for Khasra Nos. “6, 246/74, 250/99, 250/98, 260”, the Khasra Nos., “6, 245 to 260” shall be substituted;

(vii) against S.No. 7, under column heading Khasra Nos, for  Khasra No., “1218” the Khasra Nos., “300 to 600, 796 to 820”shall be substituted;

(viii) against S.No. 9, under column heading Khasra Nos, after Khasra No.”415”, the Khasra Nos. “,251, 254, 12 to 14, 20, 21, 108, 109, 406, 433, 434, 437, 439, 454, 457, 377, 378” shall be inserted;

(ix) after  S.No. 9, following shall  be inserted, namely:- 

(d) under heading “ (E) Areas to be notified as extension of existing industrial units”, in the Table- 

(i) against S.No. 1, under column heading Khasra Nos, after Khasra No. “247”, the Khasra Nos. “,125 to 131, 248 to 252, 7 to 12, 718 to 807, 845” shall be inserted;

 (ii) for S.Nos. 4 and 5, and the entries relating thereto, the following shall be substituted, namely:-  

  (iii) against S.No. 7, under column heading Khasra Nos, after Khasra No. “990”, the Khasra Nos. “,184 to 195, 747, 813, 845” shall be inserted;

(iv) against S.No. 9, under column heading Khasra Nos, after Khasra No. “4113”, the Khasra Nos. “,201 to 221, 225 to 233, 235 to 249, 254, 256 to 269, 285, 286, 341 to 351, 353 to 364, 366 to 376, 389 to 396, 400 to 403, 410/4, 599, 600, 602 to 605, 320 to 328” shall be inserted;

(v) against S.No. 10, under column heading Khasra Nos, after Khasra No. “514”, the Khasra Nos. “,430, 410 to 420, 479, 509” shall be inserted;

(vi) against S.No. 12, under column heading Khasra Nos, after Khasra No. “12”, the Khasra Nos. “,14 to 17, 153” shall be inserted; 

(e) under heading “ (F) Commercial Estates”, in the Table-               

(i) against S.No. 1, under column heading Khasra Nos, after Khasra No. “310”, the Khasra Nos. “,325, 337, 322, 324, 636/340m, 317” shall be inserted;

(ii) against S.No. 2, under column heading Khasra Nos, after Khasra No. “216-min”, the Khasra Nos. “,7, 9min, 22 min,” shall be inserted;

(iii) against S.No. 7, under column heading Khasra Nos, after Khasra No. “713”, the Khasra No. “,727” shall be inserted;

(iv) against S.No. 8, under column heading Khasra Nos, after Khasra No. “358/52-min”, the Khasra Nos. “,84, 85, 76” shall be inserted;

(v) against S.No. 9, under column heading Khasra Nos, after Khasra No. “743”, the Khasra Nos. “,721, 729” shall be inserted;

(vi) against S.No. 11, under column heading Khasra Nos, for  Khasra No. “38”,the Khasra No. “38, 159” shall be substituted;

(vii) against S.No. 13, under column heading Khasra Nos, after Khasra No. “814”, the Khasra No., “,897min” shall be inserted. 

(B) in sub-heading “(II) DISTRICT KATHUA”, - 

(a) under heading “ (C) Existing industrial locations run by   SICOP, SIDCO”, in the Table, against S.No.2, under column heading Khasra Nos, for Khasra No. “133/61/40” the Khasra Nos. “69/52, 52/27(J&K SIDCO land)” shall be substituted; 

(b) under heading “ (D) Commercial Estates established on private land”, in the Table- 

(i) against S.No. 2, under column heading Khasra Nos, for the Khasra Nos., the following Khasra Nos. shall be substituted, namely:-

(iii) against S.No. 4, under column heading Khasra Nos, after  Khasra No. “1494/34”, the Khasra Nos. “,1505/41min, 1511/64min, 65” shall be inserted;  

(c) under heading “ (F) Areas to be notified as extension of existing industrial areas”, in the Table, against S.No. 7, under column heading Khasra Nos, for Khasra No. “1-1149”, the Khasra Nos. “1-1149,1240min, 1238min, 1239min, 1241min” shall be substituted.
