Amendments in the Chapter 10 - Table B Schedule 2 (1006 - Rice)

S.O.(E) In exercise of the powers conferred by Section 5 read with Section 3(2) of the Foreign Trade (Development & Regulation) Act, 1992 (No.22 of 1992) and also read with Para 1.3 and Para 2.1 of the Foreign Trade Policy, 2004-2009, the Central Government hereby makes, with immediate effect, the following amendments to Notification No.38 (RE-2007)/2004-2009, dated 15.10.2007 as amended from time to time:

2. Consequently, the entries would be as under with immediate effect :

Exports to Russian Federation permitted subject to pre-shipment quality certification issued by Sri Ram Institute for Industrial Research or any other agency as may be notified from time to time.

2. Export permitted only if the minimum FOB price is US$ 1200 per ton or Rs.48,000/- per ton.

3. Export of Basmati Rice will be restricted through the following six ports only :

(i) Kandla

(ii) Kakinada

(iii) Kolkata

(iv) JNPT, Mumbai (as approved vide Notification No.82 dated 5.3.08.

(v) Mundra, and

(vi) Pipavav (as approved vide Notification No.84 dated 17.3.08).

 

2.1 Ban on non-basmati rice will not be applicable to exports as under :

2.1.1 Under Food Aid Programme (as approved vide Notification No.38 dated 15.10.2007).

2.1.2 To Republic of Mauritius through STC :

(a) 1000 MTs through STC (as approved vide Notification No.58 dated 26.11.2007).

(b) 9000 MTs through MMTC (as approved vide Notification No.73 dated 24.1.2008).

2.1.3 To Peoples Republic of Bangladesh :

(a) 50,000 MTs by LMJ International Ltd., 30 J.L. Nehru Road, Kolkata as per tender opened on 8.10.2007 (as approved vide Notification No.60 dated 6.12.2007).

(b) 1,010 MTs by Government of West Bengal as relief material (as approved vide Notification No.78 dated 18.2.2008).

(c) 50,000 MTs by WBECSC to be procured exclusively from the State of West Bengal (as approved vide Notification No.80 dated 18.2.08).

(d) 50,000 MTs by WBECSC and 1,00,000 MTs each by STC, MMTC, PEC and NAFED (as approved vide Notification No.81 dated 29.2.2008).

2.1.4 50,000 MTs to Madagascar through STC (as approved vide Notification No.73 dated 24.1.2008).

2.1.5 25,000 MTs to Comoros through MMTC (as approved vide Notification No.73 dated 24.1.2008).

2.1.6 40,000 MTs to Republic of Sierra Leone through PEC (as approved vide Notification No.88 dated 26.3.2008).

2.2 Ban on both non-Basmati and Basmati Rice will not be applicable to exports as under : 2.2.1 Under Bilateral Trade Agreement between Government of India and Government of Maldives (as approved vide Notification No.42 dated 23.10.2007).

2.2.2 Consignments of rice certified by Customs Authorities which have been accepted for export till 6.3.08 (mid-night) in Land Customs Stations (LCSs) in West Bengal as part of transitional arrangements (as approved vide Notification No.87 dated 24.3.2008).

2.3 Above quantitative relaxations would be applicable from the date of respective Notifications as mentioned against each entry.

3. The ban/restriction now imposed shall be applicable from midnight of 31.3.2008.

4. Transitional arrangements allowed under Para 1.5 of the Foreign Trade Policy, 2004-2009, shall, in public interest, not be applicable to the ban and restriction imposed above. However, Para 9.12 of Handbook of Procedures, Vol-1, 2004-2009, shall be applicable.
