PUBLIC NOTICE No 18 (RE-03)/2002-07 dated 24.7.2003
Amendment in the Handbook of procedure Vol.-I regarding application fee
 

  

In exercise of powers conferred under paragraph 2.4 of the Export and Import Policy, 2002-07, the Director General of Foreign Trade hereby makes the following amendment in the Handbook of Procedures (Vol.1):-

 

1.         Serial no.2 of Appendix-29 shall be amended to read as under:-

Rs. Five per thousand of duty credit subject to a minimum of Rs.Two hundred. However, for application filed electronically,Rs. 2.50/1000 of duty credit subject to a minimum of Rs.200/- 

 

12.

Application for Export Promotion Capital Goods (EPCG)

 

Rs. Five per thousand of duty saved subject to a minimum of Rs. Two hundred and a maximum of Rs. Five Lakhs. However, for applications filed electronically, the fee would be Rs. 2.50/1000 of duty saved subject to a minimum of Rs. Two hundred and maximum of Rs. Two Lakhs Fifty thousand only. 

 

2.                   The Declaration/Undertaking to be given by the Proprietor/Partner/Director in Appendix- 34 is amended as under:

     

a.   “We/I hereby declare that the said goods are imported for use in pharmaceutical and biotechnology sector and shall be used in the manufacture of commodities only.

 

b.   We/ I hereby undertake that the total value of goods imported during 2003-2004 under Customs Notification No 21/2002 will not exceed 25% of the FOB value of exports in the financial year 2002-2003.

 

c.   within 6 months of the date of importation. These goods would not be transferred or sold for a period of 7 years from the date of installation. 

            .

d.         We/I hereby declare that the Research and Development wing of the unit which has undertaken these imports is registered with the Department of Science and Industrial Research in the Ministry of Science and Technology of the Government of India.

 

e.         We/I hereby declare that the above statements are true and correct and nothing has been concealed or held there from. We/I fully understand that any information furnished if proved incorrect or false will render us/me liable for penal action and other consequences as may be prescribed in the FTDR Act 1992, Foreign Trade Regulation Rules , 1993 and Orders framed thereunder,  and any other law in force.”

 

3.         The following shall be added in Appendix 36-A at serial no. 7-

 

“ 7.  Port of Registration (for import purposes):---------    ”.

 

4.         The following shall be added in Appendix 17-D at serial no. 7-

 

“ 7.  Port of Registration (for import purposes):---------    ”.

 

5.         The Declaration at the end of Appendix 17-D shall be amended to read as under-

 

“1. I/We hereby declare that this application is based on exports earned in free    

foreign exchange during the licencing year 2002-03 and 2003-04.

 

2.        I/We further certify that I/We am/are authorised to verify and sign the statement on

behalf of the applicant.

 

3.        I/We fully understand that any information furnished in the above statement, if proved

incorrect or false, will render me/us liable to face any penal action or other consequences as may be prescribed in law or otherwise warranted.

 

4.        I/We further declare that I/We has/have not applied nor obtained another duty entitlement

certificate issued under paragraph 3.8 of the Policy based on the exports in free foreign exchange during the preceding three licensing year.

 

5.        I/We further declare that I/We shall comply with the provisions of the Exim

Policy/Handbook of Procedure (Vol.1) and the relevant Customs notification while importing the goods under the scheme and subsequent use of the same under actual user condition.

 

6.    I/We further declare that in respect of capital goods and/or office equipments,a certificate

from jurisdictional Deputy Commissioner Central Excise/Assistant Commissioner of    Central Excise or an independent Chartered Accountant, as the case may be, shall be produced confirming installation and use of capital goods and/or office equipments in the importer’s factory or premises,  within six months from the date of imports or within such extended period as the said Deputy Commissioner of Customs or Assistant Commissioner of Customs  may allow.”

 

6.         The financial power of the licensing authorities under EPCG scheme given in tabular form in Para 5.3 is amended to read as under-
